HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.665 of 2014 ORDER:

This petition is filed to withdraw O.P.No.1042 of 2014 from the file of Family Court, Ranga Reddy District and transfer the same to Senior Civil Judge, Bhongir, Nalgonda District for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of petition, according to which, her marriage was performed with respondent on 23.11.2008 at Yadagirigutta Village and Mandal, Nalgonda District, and during wedlock, they are blessed with two children i.e., Srinidhi, aged 4 years and Naga Chaitanya, aged 3 years respectively. She stated that due to harassment, she escaped from the clutches of respondent and now she is living at her parents' house in Yadagirigutta. She further stated that she lodged a complaint with Yadagiri police and the same is registered as Crime No.269 of 2013, subsequently, the same is registered as C.C.No.1192 of 2013 and pending before Junior Civil Judge, Aleru. She further stated that she filed D.V.C. No.2 of 2014 and M.C.No.

2 of 2014 and these two case are also pending before Junior Civil Judge, Aleru, Nalgonda District, but respondent intentionally filed O.P.No.1042 of 2014 before Family Court, Ranga Reddy for restitution of conjugal rights with false and baseless allegations. She further stated that it is difficult for her to travel from Yadagirigutta to Ranga Reddy, and respondent is attending Aleru Court in connection of all the three cases, and as there is no Senior Civil Judge's Court at Aleru to decide family matters, she prayed for transfer of O.P.No.1042 of 2014 from Ranga Reddy to Bhongir, which is nearest Senior Civil Judge's Court.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard argument of advocate for petitioner.

5. Considering the reasons stated in the affidavit and also considering the fact

that all the three cases are pending in Aleru Court, for which respondent is attending, O.P.No.1042 of 2014 is withdrawn from Family Court, Ranga Reddy and transferred to Senior Civil Judge, Bhongir, Nalgonda District for disposal in accordance with law.

6. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
