R.Smitha v. B.Prabhaakar
HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO CIVIL REVISION PETITION No. 1984 of 2015 DATED 22nd December, 2015 BETWEEN R.Smitha
...Petitioner
And B.Prabhakar
...Respondent.
HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO CIVIL REVISION PETITION No. 1984 of 2015 ORDER:
The revision petitioner is the wife of the respondent herein. The respondent-husband filed FCOP.No.1534 of 2014 on the file of the learned Judge, Family Court, Ranga Reddy District, at L.B.Nagar seeking dissolution of the marriage with the petitioner-wife. In the said FCOP, the respondenthusband filed I.A.No.1311 of 2014 seeking an injunction order against the petitioner-wife, her parents, relatives, agents acting on her behalf from taking his (respondent-husband) daughter, namely Shobita away from Hyderabad in order to keep her away from him without his permission. The learned Judge, Family Court initially granted interim order for some time and in the absence of the petitioner-wife, the interim order was extended subsequently by order dated 15.3.2015. Now the learned Counsel for the petitioner submits that the
petitioner-wife filed counter affidavit to the said I.A.No.1311 of 2014. Since the present Civil Revision Petition is filed against the order dated 15.3.2015 and counter affidavit is filed subsequently by the petitioner-wife to I.A.No.1311 of 2014, this Court is not inclined to make any observations on the merits or otherwise of the subject matter.
The Civil Revision Petition is therefore closed and the learned Judge, Family Court, Ranga Reddy District at L.B.Nagar, is directed to dispose of I.A.No.1311 of 2014 in O.P.No.1534 of 2014 after hearing both sides and considering the counter filed by the petitioner-wife, as expeditiously as possible, on merits.
Miscellaneous petitions pending consideration if any in the Civil Revision Petition shall stand closed in consequence. No order as to costs. --------------------------------------------------- JUSTICE A. RAMALINGESWARA RAO DATED 22nd December, 2015.
