Heard the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development and Sri P.Kesava Rao, the learned Standing Counsel for Greater Hyderabad Municipal Corporation. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.
Since this Court is not going into the merits of the case, giving notice to the unofficial respondents 4 to 6 may not be necessary.
2 . The present writ petition came to be filed seeking issuance of writ of mandamus directing respondents 2 and 3 to remove the illegal constructions made by respondents 4 to 6 in Afreen Residency, H.No.6-2-951 and 6-2-346/10/B, Street No.8, Chinthal Basthi, Khairatabad, Hyderabad.
3. Learned counsel for the petitioner submits that the petitioner, which is the Association, has been giving representations from the month of December, 2014 asking the authorities to take action for removing construction of toilet and rooms in cellar, which is dangerous to the structure of the apartment, but no action is initiated till date. He mainly submits that a direction may be given to respondents 2 and 3 to consider the representations made by the petitioner and pass orders in accordance with law.
4. Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is
disposed of directing the 3rd respondent to consider the representations dated 29.01.2015, 22.09.2015, 18.11.2015 and 18.04.2016, in accordance with law, as early as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this order, after hearing the petitioner and also the unofficial respondents.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
