HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.3526 OF 2016 ORDER:

This civil revision petition is filed by the petitioner questioning the order dated 07.05.2016, passed by the Principal Junior Civil Judge, Kavali in unnumbered E.A.No. of 2016 in E.P.No.99 of 2009 in O.S.No.389 of 2006 returning the said unnumbered E.A on the ground as to how the petition is maintainable. When this Court questioned the learned counsel for the petitioner as to why the petitioner did not re-present the said unnumbered E.A by complying the objections raised by the Court below, it is the specific submission of the learned counsel for the petitioner that inspite of efforts made by the petitioner, the Court below was not taking up the matter.

In that view of the matter, without going into merits of the revision petition, the civil revision petition is being disposed of giving liberty to the petitioner to re-present the unnumbered E.A before the Court below explaining as to how the said unnumbered EA is maintainable by answering the quarries raised by the Court below and after resubmitting the unnumbered E.A by complying with the objections, the Court below shall pass appropriate orders, in accordance with law, within a period of ten days. With the above observations, the Civil Revision Petition is disposed of. No order as to costs.

Miscellaneous Petitions, if any pending in this Civil Revision Petition, shall also stand closed.
