THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23267 of 2016 ORDER:
This writ petition is filed seeking to declare the action of respondents 3 & 4 and their police personnel in harassing the petitioners and their family members by interfering into civil disputes, interfering with the ongoing construction being carried on by the petitioners and making them to sit in the police station for hours together, as illegal and arbitrary.
Heard and perused the material available on record. The case of the petitioners is that the 1st petitioner is the absolute owner and possessor of the house property bearing Door No.9/997, situated in Gooty R.S., Gooty Mandal, Ananthapuram District and respondents 5 & 6 are in possession of the property bearing Door No.9/803 of Gooty R.S. and that there is a pathway between the properties of the petitioners and respondents 5 & 6 and that respondents 5 & 6 trying to encroach the said pathway. The main grievance of the petitioners is that respondents 3 & 4 are interfering with the construction being carried on by the petitioners and also in the civil disputes pending between the petitioners and respondents 5 & 6 and that on 09.07.2016, respondents 3 & 4 again called the petitioners to the police station and made their family members to sit in the police station for hours together and they also abused the petitioners in filthy language.
Considering the grievance of the petitioners, respondents 3 & 4 are directed not to interfere with the affairs of the petitioners and respondents 5 & 6, more particularly, with the civil disputes pending between them. However, this order will not stand in the way of
respondents 3 & 4 to register a case, if any complaint is lodged against the petitioners for cognizable offence.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 11th November, 2016 KL
