HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISON PETITION No.6408 of 2016 ORDER :

Heard and perused the record.

The civil revision case is allowed setting aside the dismissal order of the lower Court by directing the lower Court by virtue of this order to name Advocate Commissioner to record the evidence of scientific expert at the office of scientific expert at Hyderabad and for the said purpose, the petitioner-1st defendant shall bear the expenses of the plaintiff and the counsel for the plaintiff and also for any defendants and their counsel contesting in relation to it and also shall fix the commission fees and expenses by ascertain. What are the contentions raised before the lower Court in seeking to appoint another expert are left open to raise in the cross-examination of the expert.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
