HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3853 of 2008 ORDER:

The case of the petitioner is that he filed a written complaint on 10.04.2007 before the 1st respondent for proper enquiry against issuance of community certificate dated 19.02.2007 by the 2nd respondent in favour of 3rd respondent alleging that there are somany irregularities in the said community certificate and that the same was issued by the 2nd respondent without following the procedure enumerated in A.P.(Scheduled Castes, Scheduled Tribes and Backward Classes) Regulation of Issue of Community Certificates Act, 1993 and the Rules framed there under. As no action is being taken on the said complaint, present writ petition is filed. Respondents 1 and 2 filed counter stating that basing on the complaint given by the writ petitioner, the 2nd respondent addressed a letter to the District Collector, Hyderabad1st respondent, vide letter No.

B/782/2007, dated 20.06.2008 with a request to refer the matter to the District Level Scrutiny Committee for verification as per Rule 8 of G.O.Ms.No.58, SWJ, Dated 12.05.1997 and to give suitable recommendations. Heard learned counsel for the petitioner, learned Senior Counsel for the 3rd respondent and learned Assistant Government Pleader for social welfare.

Since it is stated in the counter that already letter was addressed to the District Collector-1st respondent, it is for the 1st respondent to take action, in accordance with law. In view of the same, the writ petition is disposed of directing the 1st respondent to take action, in accordance with law after issuing notice to the affected parties. No order as to costs.
