HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 17503 of 2016 Order:

The petitioner worked as Manager in the second respondentBank and retired from service on 30.04.2015 on attaining the age of superannuation. After retirement, he submitted an application before the respondent authorities seeking settlement of his gratuity and other retirement benefits. The second respondent issued a circular dated 06.05.2015 to the third respondent and other Branch Managers to furnish certain information relating to the petitioner to the Central Office on or before 20.05.2015 so as to enable it to place before the Board of Management for settling the superannuation benefits of the petitioner. When no information was received by the second respondent and since the second respondent did not settle the retirement benefits, the petitioner submitted a written representation on 23.10.2015 for settling his retirement benefits. When the same was also not considered, the present Writ Petition was filed.

2. Even after receiving notice before admission and even though four weeks time was granted, there is no representation on behalf of the respondents.

3. It is clear from the above facts that the petitioner retired from service on 30.04.2015 and the second respondent sought information from the third respondent and other branches where the petitioner worked. The third respondent was working under the control of the second respondent only. The retirement benefits of the petitioner cannot be held up for want of information from the other branches. Since the matter has been hanging fire for the last one year and this Court is constrained to dispose of the Writ Petition with a direction to the second respondent to settle the retirement benefits by considering the representation of the petitioner dated 23.10.2015 within a period of three (3) months from the date of receipt of a copy of this order.

4. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
