THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 8481 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.439 of 2022 on the file of Chandrayangutta Police Station, Falaknuma, Hyderabad, for the offences punishable under Sections 328, 336, 420 read with 34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The petitioner and another were found in possession of

1) 13X10 M.L. injections of Mephentermine sulphate 2) 03X10 ML Injections of Mephentermine sulphate 3) 02X10 ML Injections of Mephentermine. The said drug was being sold without proper licence for which reason the Drugs Inspector conducted raid in the premises of the petitioner and seized the said drugs. The same were handed over to the Inspector who registered the crime for the said offences. 4.

As seen from the allegations in the complaint, Section 328 is not attracted for the reason of there being no allegation that the said injections were administered on anyone. The other offences are punishable less than 7 years.

The petitioner is in jail since 29.07.2022. When there are no other similar criminal cases pending against this petitioner, this petitioner can be granted the relief of regular bail on the following conditions; i) The petitioner/A1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Chief Metropolitan Magistrate, Hyderabad.

(ii) The petitioner/A1 shall appear before the concerned Station House Officer, on every Monday and Thursday between 10.30 A.M. to 1.00 P.M. for a period of eight weeks or until filing of charge sheet, whichever is earlier.

iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
