THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Tr.CMP.No.454 of 2018 O R D E R:
This Tr.CMP. is filed under Section 24 of the CPC seeking transfer of O.P.No.1991 of 2017 on the file of Family Court, Ranga Reddy District at Miyapur to the Family Courtcum-Additional District and Sessions Judge, Karimnagar. 2.
It is not in dispute that earlier petitioner had filed Tr.CMP.No.61 of 2018 before this Court seeking transfer of the said O.P. from the Family Court, Ranga Reddy District to the Court of Senior Civil Judge, Peddapalli, but the said Tr.CMP. was not ordered on the ground that the case pending before the Family Court was presided over by an Officer in the cadre of District Judge and so it cannot be transferred to a Court presided over by a Senior Civil Judge, who is sub-ordinate in rank to the District Judge. No doubt certain reliefs were granted regarding appearance of the petitioner in the O.P.

Now the petitioner contends that there is a Family Court-cum-Additional District and Sessions Judge, Karimnagar and the O.P. be transferred to the said Court from the Family Court, Ranga Reddy District at Miyapur, since she is finding difficult to travel from Peddapalli to
Hyderabad, which is at a distance of about 200 Kms. to attend the Court and she also has a minor son to take care. 4.
Though counsel for the petitioner opposed the said contentions and contended that the reliefs granted to the petitioner in the earlier Tr.CMP. can still be maintained and would obviate any hardship to the petitioner, having regard to the fact that petitioner is a lady, having to take care of a minor son, and is required to travel from Peddapalli, which is 200 Kms. away from Hyderabad, to Hyderabad to attend Family Court at Ranga Reddy District, in the interest of justice, this Tr.CMP. is allowed and O.P.No.1991 of 2017 on the file of Family Court, Ranga Reddy District at Miyapur is transferred to the Family Court-cum-Additional District and Sessions Judge, Karimnagar. No order as to costs. 5.
Consequently, miscellaneous petitions pending if any, shall stand closed.
