THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40486 OF 2015 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents 3 to 5 in harassing the petitioner at the instance of the sixth respondent without therebeing any crime registered against the petitioner and making him to sit hours together as illegal and arbitrary, and consequently, to direct the respondents 3 to 5 not to interfere with the personal liberty at the instance of the sixth respondent without therebeing any complaint registered against him. Heard and perused the material.

Learned counsel for the petitioner submits that the respondents 3 to 5 are interfering in the civil dispute between the petitioner and the sixth respondent and that respondents 3 to 5 are calling the petitioner to the police station and made him to sit in the police station hours together unnecessarily and as such, he prays this Court to direct the respondents 3 to 5 not to interfere in the civil disputes between the petitioner and sixth respondent.

Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the respondents 3 to 5 are not interfering in the civil disputes, more particularly, the civil dispute between the petitioner and sixth respondent.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the respondents 3 to 5 not to interfere in the civil disputes between the petitioner and the sixth respondent and not to harass the petitioner either by calling him to the police station or in any other manner, without therebeing any case registered against the petitioner for any cognizable offence. The

respondents 3 to 5 are also directed to follow the due process of law laid down in Code of Criminal Procedure.
