ORDER :

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of the first respondent in not granting stay of the Award passed by the 2nd respondent-Deputy Registrar of Chits in Arbitration Claim Petition No.41/2018, dated 12.10.2018, while admitting the appeal, as illegal and unconstitutional.

The case of the petitioner is that against the order passed by the 2nd respondent-Deputy Registrar of Chits, he preferred an appeal before the Government of Andhra Pradesh, Revenue (Registration II) Department, vide Memo.

No.23957/Regn.I/A1/2019-1, dated 13.12.2019. Along with the appeal, the petitioner claims to have filed an application seeking stay of the orders of the Deputy Registrar of Chits passed in Arbitration Claim Petition No.41/2018. It is the contention of the petitioner that without adjudicating the stay application, the matter was adjourned admitting the appeal. 5.

Learned Government Pleader for Revenue submits that if interim application is still pending consideration, the authorities may be directed to consider the same.

Recording the above submissions made, the writ petition is disposed of directing the first respondent to dispose of the stay application filed along with the appeal vide Memo No. Memo. No.23957/Regn.I/A1/2019-1, dated 13.12.2019, within a period of four weeks from the date of receipt of a copy of the order. Till such time, there shall be stay of operation of the order passed by the Deputy Registrar of Chits passed in Arbitration Claim Petition No.41/2018. Pending miscellaneous petitions, if any, shall stand closed.
