ORDER:

Feeling aggrieved by the inaction of respondent No.4 in removing the unauthorised constructions allegedly made by respondent No.5, the petitioners filed this writ petition. At the hearing, Sri V.Siva Prasad Reddy, learned counsel for the petitioners, placed before the Court a copy of the order, dated 20.08.2015, in W.P.No.19075 of 2015, filed by respondent No.5 feeling aggrieved by notice, dated 26.06.2015, issued by respondent No.4 for removing the constructions made by him.

A perusal of this order would show that respondent No.4 has filed a counter affidavit in the said writ petition, wherein it was averred that the Panchayat Secretary has personally visited the spot and

noticed deviations from the sanctioned plan and issued notice on 26.06.2015 directing respondent No.5 to remove the said deviations. Considering the said averments, this Court has disposed of the writ petition permitting respondent No.5 to submit his explanation within two weeks from the date of receipt of the order and a direction was also issued to the Panchayant Secretary to pass appropriate orders within two weeks of his receiving the explanation, if any, from respondent No.5.

Sri G.Seshadri, learned counsel for respondent No.4, is unable to state as to whether the process as directed by this Court has been completed or not. Inasmuch as a direction was already given by this Court to respondent No.4 to consider the explanation, if any, submitted by respondent No.5 and pass an order, it would be appropriate to reiterate the said directions.

Accordingly, the writ petition is disposed of with a direction to respondent No.4 to act with expedition and complete the process of considering the explanation, if any, submitted by respondent No.5 and take appropriate action depending upon the decision it takes within a period of one month from the date of receipt of a copy of this order. As a sequel to disposal of the writ petition, WP.M.P.No.43423 of 2015 shall stand disposed of as infructuous.
