HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.13044 of 2016 ORDER:
A notice under Section 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007 dt.29.12.2015 was issued to the petitioner to show cause why he should not be evicted from the lands in his occupation, alleging that the said land is assigned land. The petitioner gave an explanation on 11.01.2016 to respondent No.4, who issued the said notice disputing that the land is assigned land and contending that the land is private land, which he had obtained under a sale deed on 04.07.1975. The petitioner contends that without passing a final order, respondent No.4 is threatening to dispossess him from the subject land.
Learned Government Pleader for Revenue appearing for respondents states that respondent No.4 will pass a reasoned order, after considering the explanation of the petitioner.
Therefore, the writ petition is disposed of directing respondent No.4 to consider the petitioner's explanation dt.11.01.2016 to the show cause notice dt.29.12.2015 issued by him and pass a reasoned order in accordance with law and till such order is passed by respondent No.4, the petitioner shall not be dispossessed from the subject property by the respondents. No costs.
Consequently, the miscellaneous applications pending, if any, in this Writ Petition shall stand dismissed.
