THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33261 of 2015 ORDER:
The grievance of the petitioner is with regard to the action of the authorities in permitting the fifth respondent to shift his licenced premises. The petitioner claims to have submitted his objections by way of representation dated 06.10.2015 to the Commissioner of Prohibition and Excise, Hyderabad.
As the petitioner's representation is pending consideration before the competent authority, this Court does not deem it necessary to keep the matter pending or adjudicate the issue on merits. As the order proposed to be passed by this Court is not on merits and does not cause any adverse impact on the fifth respondent, this Court does not deem it necessary to put the fifth respondent on notice at this stage.
The writ petition is disposed of directing the second respondent to consider the petitioner's representation dated 06.10.2015 and upon giving due opportunity of hearing to both parties, take necessary action in the matter in accordance with law. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
