THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 28772 and 28844 of 2019 COMMON ORDER:

As the subject matter of these Writ Petitions is one and the same, they are being disposed of by this common order. Heard learned counsel for the petitioners and learned Standing Counsel for the Telangana State Road Transport Corporation appearing for the respondents.

The petitioners are the contractors for maintenance and upkeep of toilets at Jedcherla Bus Station and Kolapur Bus Station respectively under the Repair Operation and Maintenance Scheme for a period of five years and the term of the contract has already been expired, as such, they submitted representations dated 11.12.2019 for extending the contract for six more months. Their grievance is that so far, no orders have been passed on the representations.

There is no dispute that the Corporation had issued a tender notification on 24.12.2019 calling for fresh bids for fixing up a contract for maintenance and upkeep of toilets. However, as on date, the process of selection of a contractor has not been finalized. Though, as a matter of right, the petitioners cannot insist upon the Corporation to continue or extend the licence as sought by them, in the facts of the present case, as the new contractors are yet to be selected in the tender process, till such time the fresh contractors are selected, the petitioners may be continued. This

observation shall not be construed as conferment of any right on the petitioners and the same is only for the purpose of ensuring continuity and maintenance of toilets till new contractor is appointed.

Subject to the above, the writ petitions are disposed of. Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:27.12.2019 kdl
