HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5386 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/ accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.31 of 2015 of Narayankhed Police Station, Medak District, registered for the offences punishable under Section 3 (1) (x) of SC, ST (POA) Act, 1989.

2) Heard learned counsel for the petitioner/ accused as well as learned public prosecutor representing 1st respondent-State before admission and before ordering notice to 2nd respondent. Perused the material on record.

3) As the material falls short for this Court to admit the application filed under Section 482 Cr.P.C, the facts to admit the entitlement to concession of bail to the petitioner, who is no other than co-judicial employee in the same Court where the de facto complainant also works and the accused is a lady.

4) Having regard to the above, the application is disposed of, giving liberty to the petitioner to surrender before the Special Judge concerned with an application for regular bail and with notice to special public prosecutor, in such event, the Special Judge consider the same with necessary conditions. The investigation shall go on, any remedy of the petitioner in the event of final report by

police. The learned Magistrate can dispense with their presence pending investigation before the Court.

5 ) Miscellaneous petitions, if any pending, shall stand closed.
