THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.9694 of 2021 ORDER:

The petitioner/A-1 filed the present Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure seeking to enlarge him on bail in connection with Cr.No.192 of 2021 pending on the file of Mattampally Police Station, Suryapet district, which was registered for the offence punishable under Section 2(b)(ii)(B) of N.D.P.S. Act.

Heard the learned counsel for the petitioner/A-1, the learned Public Prosecutor representing the respondent-State and perused the record.

The allegation against the petitioner herein is that he has involved in sale of Ganja. Two kgs. of Ganja was recovered from his possession. He was arrested on 19.10.2021. 4.

Learned Public Prosecutor, on instructions, would submit that there is no case other than this case against the petitioner herein and the Investigating Officer has completed investigation and F.S.L. report is awaited. The bail application filed by A2 is allowed by this Court in Crl.P.No.9504 of 2021. 5.

In view of the same, according to this Court the petitioner / A-1 is entitled for bail.

Therefore, the Criminal Petition is allowed and the petitioner/A-1 is directed to be released on bail, subject to the following terms and conditions:

(i) The petitioner/ A-1 shall be released on bail on his executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousands only) with two sureties for a like sum to the satisfaction of the I Additional District and Sessions Judge, Nalgonda district.

(ii) That the petitioner/A-1 shall co-operate with the investigating agency.

(iii) That the petitioner/A-1 shall not misuse the liberty granted to him.

(iv) That the petitioner/A-1 shall appear before the Investigating Officer personally on every Sunday between 10.00 AM and 5.00 PM till completion of investigation and filing of final report.

As a sequel, miscellaneous petitions, if any, pending in the criminal petition shall stand closed.
