THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.17774 of 2009 ORDER:

The petitioner complains against rejection of the claim of the petitioner for promotion to the post of Junior Accounts Officer by 1st respondent, as illegal, arbitrary and unconstitutional. On 14-06-2010 in W.P.M.P.No.23299 of 2009, this court directed the respondents as follows:- "There shall be interim direction to respondents to consider the representation purported to have been made by the petitioner on 27-07-2009 seeking promotion to the post of Junior Accounts Officer (JAO) on adhoc basis as was done in the case of similarly situated persons and pass appropriate orders, as per law, within a period of four weeks form the date of receipt of a copy of this order."

From the above, it is clear that a direction was issued to respondents to consider the representation of petitioner and if the representation is disposed of and any communication is made, the communication gives fresh cause of action and the petitioner has to work out the remedies independently. In the alternative, if the representation remains unattended, in spite of the direction of this Court, this court is satisfied that the interim direction can be made final direction and respondents are directed to pass final orders within four weeks from the date of receipt of a copy of this order. The writ petition is disposed of as indicated above. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
