This Transfer Civil Miscellaneous Petition is filed by the petitioner, requesting to withdraw O.S.NO.323 of 2016 pending on the file of I Junior Civil Judge, City Civil Court, Secunderabad, and transfer the same to the Court of I Additional Chief Judge, City Civil Court, Secunderabad, for trial and disposal along with O.S.No.165 of 2014, in accordance with law.

Heard the learned counsel for the petitioner and perused the record.

In the course of submissions, it is brought to the notice of this Court that the petitioner has not filed a petition under Section 24 of CPC before the Chief Judge, City Civil Court, Hyderabad, seeking the relief sought in this petition. The petitioner ought to have done so, in view of the mandate given under Section 24 of CPC. Under these circumstances, no order is required to be passed in this Transfer Civil Miscellaneous Petition. 4 .

With the above observation, this Transfer Civil Miscellaneous Petition is disposed of. No costs.

Miscellaneous petitions, if any, pending in this Transfer CMP, shall stand closed.
