Heard Mr. Bollam Lingaiah Yadav for petitioners and Mr. Venkat Yadav for respondents.

Petitioners challenge the panchanama dated 21.10.2016 seizing the stock of sugar 1589 quintals and lorry bearing Nos.AP 12 U 8010, AP 24 Y 6333 and AP 31 TB 0266 as illegal, arbitrary and contrary to the provisions of the Essential Commodities Act. 3.

On instructions, counsel appearing for parties submit that the enquiry pending before the second respondent is adjourned to 15.11.2016 at 3 PM and in the meantime, interim order directing sale of sugar by public auction is also ordered. It is further brought to the notice of the Court that the vehicles are already released since the bank guarantee, as directed by the authority, is already furnished. 4.

Having regard to the above circumstances, the writ petition is ordered as follows:

1. The second respondent shall complete the hearing, scheduled to be held on 15.11.2016, on or before 24.11.2016 and communicate orders to petitioners.

2. Till the enquiry is completed and orders communicated to petitioner, there shall be stay of sale of sugar seized under panchanama dated 21.10.2016.

As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs. ____________ S. V. BHATT, J November 4, 2016/ DSK
