HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 1062 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

This writ appeal is directed against the order dated 17.11.2015 dismissing Writ Petition No.36451 of 2015 filed by the appellant. The appellant, in the writ petition, sought direction to the respondents to consider their representation whereby they sought permission to resume sand quarrying operations in Reach No.8(a) of Vykunthapuram Village, Amaravathi Mandal, Guntur District. The learned Judge dismissed the writ petition with the following observations:

"I find merit in the above submissions of the learned Assistant Government Pleaders. In the first place, having surrendered the quarry lease, unless either the policy existing at the time of grant of quarry or the quarry lease contains any clause providing for restoration of the permit surrendered by a lessee, the petitioner is not entitled to claim such restoration. At any rate, not only that the period for which the quarry lease was granted to the petitioner has expired, but also a new policy has come into effect after the quarry lease was granted to the petitioner."

For the reasons stated in the order, we do not find any reason to interfere with the same.

Learned counsel for the appellant could not and did not make out any ground to interfere with the order impugned in the present writ

appeal.

The appeal is dismissed.
