HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.35234 of 2016 ORDER:

Petitioner challenges show cause notice-cum-suspension order on several factual and legal grounds.

Learned counsel appearing for the petitioner reiterated the grounds to convince the Court that the enquiry can go on, but placing the petitioner under suspension, in the fact situation of this case is completely illegal and unwarranted, prays for suspending the order of suspension of fair price shop authorization. I have perused the charges and the plausible explanation of the petitioner against these charges offered through the affidavit in this writ petition. This Court is of the view that the matter involves enquiry and ascertainment of truth in the charges levelled against the petitioner. Therefore, instead of considering the merits of the show cause notice-cum-suspension order, this Court considers it appropriate to direct respondent No.3 to positively complete the enquiry and pass final orders in accordance with the applicable Government Orders, within two months from today. Writ petition is accordingly disposed of.
