THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21952 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Roads and Buildings. With their consent, the present Writ Petition is disposed of at the admission stage.

2. The Writ Petition is filed with the following prayer: "to issue writ, order or direction especially one in the nature of writ of Mandamus declaring the action of the respondents in proposing to recover an amount of Rs.15,11,622/- from the work bills of the petitioner without issuing any notice and without conducting enquiry and without considering the representation dated 02.01.2016 is illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents 2 to 5 to consider the representation dated 02.01.2016 and pass orders before effecting the recovery of an amount of Rs.15,11,622/- from the work bills of the petitioner."

2. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the Executive Engineer (R&B)-Respondent No.5 to dispose of the representation dated 02.01.2016 made by the petitioner at the earliest.

3. Learned Government Pleader for Roads and Buildings did not dispute the same and submits that the respondents will consider the same, provided the same is still pending consideration.

4. Having regard to the above, the Writ Petition is disposed of directing the 5th respondent to consider the representation dated 02.01.2016 made by the petitioner and pass appropriate orders

thereon as early as possible preferably within a period of two (02) weeks from the date of receipt of a copy of this order, after giving an opportunity of personal hearing to the petitioner herein.
