THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 11796 of 2015 ORDER:

This Writ Petition has been filed challenging the inaction of the 3rd respondent-Revenue Divisional Officer, Anantapur, Anantapur District in reconveying the agricultural land in an extent of Ac.4.29 cents in Sy.No.428 of Vajrakarur Village and Mandal, Anantapur District as per the orders of the Land Reforms Appellate Tribunal, Anantapur dated 7.11.1977 in LRA No.549 of 1977. Brief facts of the case are that vide proceedings in C.C.No.730/75/UKD dated 17.3.1977 the 2nd respondent-Land Reforms Tribunal, Anantapur declared the original declarant therein as surplus holder to an extent of 0.8490 S.H. Aggrieved by the said order, the petitioner herein claiming to be adopted son of Smt. Narasamma filed appeal in LRA No.549 of 1977 before the Land Reforms Appellate Tribunal, Anantapur.

The Tribunal considering the fact that the petitioner is adopted son of Smt. Narasamma allowed the appeal in part holding that the petitioner is also entitled to one share among 6 daughters of Smt. Narasamma and accordingly declared that Smt. Narasamma is surplus holder to an extent of Ac.0.7590 S.H. instead of 0.8490 S.H. vide order dated 7.11.1977 in LRA No.549 of 1977. Thereafter, the petitioner filed application before the 2nd respondent-Land Reforms Tribunal, Anantapur to reconvey an extent of Ac.4.29 cents situated in Sy.No.428 of Vajrakarur Village and Mandal, Anantapur District by remitting the necessary amount. Heard the learned counsel on either side.

In view of the orders passed by the Land Reforms Appelalte Tribunal, Anantapur in LRA No.549 of 1977 dated 7.11.1977 holding that original declarant therein was surplus holder to an extent of 0.7590 S.H. instead of 0.8490 S.H., I am inclined to dispose of the writ petition at the admission stage itself directing the 3rd respondent-Revenue Divisional Officer, Anantapur, Anantapur District to steps for implementations of orders of the Land Reforms Appellate Tribunal, Anantapur and deliver the possession of the land over an extent of Ac.4.29 cents in Sy.No.428 of Vajrakarur Village and Mandal, Anantapur District in favour of the petitioner herein within a period of three months from the date of receipt of copy of this order, as per law. No costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
