THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.9689 of 2021 ORDER:

The petitioners/A2 and A3 filed the present Criminal Petition under Section 438 of the Code of Criminal Procedure seeking to grant anticipatory bail to them in connection with Cr.No.276 of 2021 pending on the file of Mushirabad Police Station, Hyderabad, which was registered for the offence punishable under Sections 420, 406 r/w 34 of IPC. 2.

Heard Sri Mahesh Raje, learned counsel for the petitioners/A2 and A3, the learned Public Prosecutor representing the respondent-State and perused the record. 3.

The allegation against the petitioners herein is that they have misappropriated certain amounts of Gouda Sangham, Musheerabad, being the managing committee members of the said Sangham. In the F.I.R., the alleged misappropriation of amount is mentioned as Rs.50,000/- in figures and fifty lakhs in words.

The learned Public Prosecutor, has placed before this Court the written instructions dated 15.12.2021 of the Investigating Officer along with charge sheet in C.C.No.13161 of 2021 in the above crime and submits that the Investigating Officer has completed the investigation by duly following the procedure laid down under Section 41-A of Cr.P.C.

In the charge sheet, the alleged misappropriation amount is shown as Rs.5.00 lakhs. Thus, there is a discrepancy in the alleged misappropriation amounts. The said written instructions are placed on record.

Considering the above said facts, this Criminal Petition is closed. As a sequel, miscellaneous petitions, if any, pending in the criminal petition shall stand closed.
