HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.125 of 2015 ORDER:

This petition is filed to withdraw O.S.No.241 of 2014 from the file of VII Additional District Judge, Gudur, SPSR Nellore District and transfer the same to IV Additional District Judge, Nellore or to any other District Court having jurisdiction at Nellore for disposal in accordance with law.

2. Petitioner herein is plaintiff in the above referred O.S.No.241 of 2014 and according to his affidavit, Presiding Officer of the Court is residing as a tenant in the house of relatives of first respondent herein and petitioner apprehend that he may not get fair justice as the respondents are proclaiming that they will get favourable orders. It is further sated that originally suit was filed at Nellore and it was pending before V Additional District Judge, Nellore as O.S No.337 of 2012, but due to recent establishment of Court at Gudur, on the point of jurisdiction, this suit was transferred to Gudur.

3. Other respondents remained absent in spite of service of notice and R-1 and R-2 have not filed any counter.

4. Heard both sides.

5. Other side advocate represented that he has no objection for transfer of suit provided some time is fixed for disposal of the suit.

6. Considering the reasons stated in the affidavit and also considering the submissions of both sides, O.S.No.241 of 2014 is withdrawn from the file of VII Additional District Judge, Gudur, SPSR Nellore District and transferred to IV Additional District Judge, SPSR Nellore, for disposal in accordance with law. IV Additional District Judge, SPSR Nellore District shall dispose of the suit, as

expeditiously, as possible, preferably, within nine (09) months from the date of receipt of the records.

7. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
