Heard Sri Srinivas Ambati, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj, Sri MSR Chandramurthy, learned special counsel for the 4th respondent and Sri G. Seshadri, learned standing counsel for the 5th respondent.
2 . The petitioner was appointed as Field Assistant at Kallada Gram Panchayat, Nandigam Mandal, Srikakulam District under MGNREGS on 25.05.2007. Levelling certain charges, a show cause was issued to the petitioner alleging that she misappropriated an amount of Rs.4398/- and she was also suspended vide impugned order dated 01.05.2015 passed by the 4th respondent. Learned counsel appearing for the petitioner submits that the charges levelled against the petitioner are baseless and there is no scope to misappropriate the amount relating to the labour.
3. In any event, the order impugned is passed in contemplation of an enquiry; I am not inclined to go into the merits of the impugned order. Therefore, the 4th respondent is directed to conduct enquiry against the petitioner in accordance with law and pass appropriate final orders, after affording opportunity of hearing and considering the explanation submitted by her, within a period of eight (8) weeks from the date of receipt of a copy of this order, failing which the order of suspension shall stand revoked.
4. The writ petition is accordingly disposed of at the state of admission. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
