HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8548 of 2019 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.556 of 2019 on the file of the XVI Addl. Chief Metropolitan Magistrate, Hyderabad against the petitioners-A1 to A3, which was taken cognizance of the offences punishable under Sections 272, 273 and 336 IPC and 20 (2) of COTP Act, 2003.

Learned counsel for the petitioners and learned Addl. Public Prosecutor representing the State submit that the issue involved in this Criminal Petition is squarely covered by the order, dated 27.08.2018 passed by this Court in Crl.P.No.3731 of 2018 and batch. However, learned Addl.

Public Prosecutor submits that the proceedings insofar as the offences punishable under Sections 272, 273 and 336 IPC may be quashed and the proceedings for the offence punishable under Section 20 (2) of COTP Act, 2003 may not be quashed.

In view of the submission made by the learned Addl. Public Prosecutor and following the order passed by this Court in Crl.P.No.3731 of 2018 and batch, dated 27.08.2018, the Criminal Petition is allowed quashing the proceedings against the petitioners-A1 to A3 insofar as the offences punishable under Sections 272, 273 and 336 IPC

are concerned and the Criminal Petition is dismissed insofar as the offence punishable under Section 20 (2) of COTP Act, 2003 is concerned. Miscellaneous petitions, if any pending shall stand closed.
