HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.9022 of 2017 ORDER:

Heard learned counsel for petitioners and this petition is disposed of at the admission stage.

2) It is seen that this Criminal Petition is filed by petitioners/A1 to A5 to quash the proceedings against them in C.C.No.473 of 2017 pending on the file of Judicial First Class Magistrate, Miryalaguda, Nalgonda District wherein the petitioners are alleged to have committed offence under Section 498A IPC and Sections 3 and 4 of Dowry Prohibition Act.

3) In view of the fact that the matter is coming before the trial Court for framing of charges, it is not apt to take up the quash petition at this stage. Hence, while dismissing the petition liberty is given to the petitioners to approach the trial Court and seek for discharge if they are so advised, in which case the trial Court shall pass an appropriate order on merits. 4) Having regard to the submission of learned counsel for petitioners that A2 to A5 are not main accused and A2 and A3 are aged persons and A5 is married lady, the presence of A2 to A5 before the trial Court is dispensed with except on the occasions where the trial Court requires their attendance. 5) Accordingly, this Criminal Petition is dismissed.
