The petitioner herein, who is working as a Physiotherapy Assistant with the National Institute for the Mentally Handicapped at Manovikasnagar, Secunderabad, challenges the legality and validity of the order passed by the Deputy Director (Administration) on 31-032015 transferring him, on temporary basis, to the Resource Center, Gangtak, Sikkim with immediate effect, until further orders. The matter was heard on the previous occasion on 08-04-2015 and to enable Sri B. Narayana Reddy, learned Assistant Solicitor General to secure further instructions, it was adjourned to today.
Today, Sri Narayana Reddy secured instructions and based thereon, he would submit that for want of the service of a Physiotherapy Assistant, the petitioner has been posted to the Resource Center, Gangtak, Sikkim, on a temporary basis, and he is transferred initially for a period of 180 days only. Therefore, the petitioner need not apprehend that he has been subjected to a regular transfer to Sikkim. Sri Narayana Reddy would assure this Court that the transfer of the writ petitioner now ordered will be appropriately reviewed after the expiry of this 180-day tenure and all relevant factors would be taken into account and consideration at that stage.
When once, in larger public interest, the writ petitioner has been transferred, particularly with an assurance that his transfer order will be reviewed appropriately after 180 days, it is not proper for this Court to interfere with any such administrative transfer as of now. Therefore, preserving liberty to the writ petitioner to bring out all such necessary and relevant facts to the notice and consideration of the competent authority to enable an appropriate review of the order of transfer at the end of 180-day tenure, the writ petition stands disposed of at the admission stage, but however, without costs.
Consequently, the miscellaneous petitions, if any, stand disposed of.
