HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 35243 of 2016 ORDER:

1) Heard learned counsel for the petitioner, Government Pleader for Revenue and Sri S.Lakshminarayana Reddy, learned Standing Counsel appearing for respondent No.4-Corporation. With the consent of both the parties, the writ petition is heard at the admission stage itself.

2) The present writ petition came to be filed questioning the very issuance of notice vide Lr.No.723/ 2016/ A, dated 30.09.2016, demanding the petitioner to give an explanation within seven days, either in person or in writing, before the Tahsildar, Anakapalli as to why he should not be evicted from the Government Land and also as to why his buildings, constructions and things deposited therein should not be forfeited under Section 6 of the Andhra Pradesh Land Encroachment Act. 3) Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to follow due process of law before taking any coercive steps.

4) Learned Standing Counsel for respondent No.4 would submit that if any action is sought to be taken, the same will be in accordance with law.

5) Recording the said submission, the writ petition is disposed of directing the petitioner to submit explanation to the notice

dated 30.09.2016, in which event the respondent authorities shall deal with the same in accordance with law. It is needless to mention that if any action is taken either for dispossession or demolition, the same shall be in accordance with law. No order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
