HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 21628 of 2001 ORDER:

This writ petition is filed by the petitioners, under Article 226 of the Constitution of India, seeking a writ of mandamus to declare the action of the respondents in not paying the differential amount of gratuity and commutation of pension due to them, in view of the enhanced limits ordered in G.O.Ms.Nos.157 and 158, Finance & Planning (FW-PEN.I) Department, dated 16.09.1999. Heard Mr. K. Raghuveer Reddy, learned counsel for the petitioners, and Mr. Deepak Bhattacharjee, learned standing counsel for Osmania University, appearing for the 1st respondent. A counter affidavit is filed on behalf of the 1st respondentUniversity stating that the Government did not provide any funds to the University for implementation of the above Government orders; and that on a reference made by the University, the Secretary to the Government vide Lr.No.

15193/U.E.I-2/2000-2002, dated 19.03.2001, has informed that the proposal for release of additional funds has not been agreed to, in view of the zero based budget implemented during the year 2000-2001 and, therefore, the benefits given under the Government Orders could not be extended to the petitioners.

AKS,J WP No. 21628 of 2001 benefits under the Government Orders. Therefore, the Writ Petition is dismissed.
