THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.5093 OF 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner seeks grant of duplicate pattadar passbook and she made an appropriate application on online before the Tahsildar, Guntur Mandal and District, the 4th respondent, to that effect. She also made a representation before the 1st respondent, who, vide memo, dated 22.11.2015, Ex.P1, directed the District Collector, Guntur District, the 2nd respondent, to examine and take necessary action on the petitioner's application. Alleging inaction on the part of the 4th respondent in furnishing duplicate pattadar passbook and also the action of the 5th respondent in encroaching into the part of the subject land, the present Writ Petition is filed.
It is apparent that the petitioner seeks action against the alleged encroacher and also grant of duplicate pattadar passbook. To the extent of grant of duplicate pattadar passbook is concerned, the petitioner needs to be made an appropriate application in accordance with Rule 31 of the Andhra Pradesh Rights in Land and Pattadar Passbooks Rules. However, the petitioner appears to have been made no such application before the 4th respondent. Therefore, the petitioner is at liberty to make an appropriate application before the 4th respondent and if such application is received, the 4th respondent shall examine the same and take necessary action, in accordance with law, including the action, if any, warranted against the alleged encroacher.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
