IA.No.1 of 2019 is filed by the petitioners/proposed respondents 7 to 36 seeking to implead them as respondents 7 to 36 in the writ petition and also seeking to withdraw the writ petition to the extent of their interest and also to dismiss the writ petition against the remaining writ petitioners.

Learned Counsel for the implead petitioners/proposed respondents 7 to 36 states that the writ petition was filed in their names and also in the name of dead persons. He also states that some implead petitioners are legal heirs of those dead persons. He further states that except petitioners 1, 2, 7 and 21 all other petitioners are impersonated; that the implead petitioners are not aggrieved by the impugned order in the writ petition and that they have no intention to challenge the impugned order. He also states that by virtue of pendency of this writ petition, Government is not taking any action for implementation of the impugned order in the writ petition and that in fact the implead petitioners wants the impugned proceedings should be implemented. When the matter is listed on 19.02.2019 and 16.12.

2019, there is no representation on behalf of writ petitioners and when the matter is listed on 19.12.2019 it is represented that the counsel for the writ petitioner was unwell and sought adjournment. Thereafter, when the matter is listed on 03.02.2020, 06.02.2020 and 17.02.

representation on behalf of writ petitioners, as such, this Court directed to post this matter under the caption 'for dismissal' to this date i.e. 18.02.2019.

Even when the matter is listed to-day under the caption 'for dismissal', there is no representation on behalf of petitioners. No counter affidavit is filed in IA.No.1 of 2019. In view of the same, IA.No.1 of 2019 is allowed. The writ petition is dismissed as withdrawn in respect of writ petitioners 4, 5, 6, 8, 9, 11, 12, 13, 14, 16, 19, 20, 26, 28 and 30 are concerned, since it is stated by the said respective implead petitioners 30, 28, 10, 11, 26, 5, 16, 17, 24, 9, 22, 25, 29, 1 and 21 that they are impersonated; that they are not aggrieved by the impugned order and that they have no intention to challenge the impugned order. Writ petition is dismissed in respect of petitioners 3, 10, 17, 18, 24, 25, 27 and 22 since it is stated by their legal heirs who are impleaded petitioners No. 27, 7, 13, 19, 14, 6, 2 that the above writ petitioners died and the writ petition is filed impersonating dead persons.

The writ petition in respect of remaining petitioners 1, 2, 7, 15, 21, 23, 29 is concerned, is dismissed for non prosecution.
