THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.21548 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the official respondents causing harassment and threats on false complaints made by the 3rd respondent, in connection with a land dispute, which is civil nature, as illegal, arbitrary, misconceived, beyond its jurisdiction and detrimental to the fundamental rights of the petitioner and canons of fair play and natural justice and consequently direct the respondent No.3 not to call the petitioner to Police Station in connection with the civil dispute of the respondent No.4."

Heard Sri K. Ravikanth, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court. Today, when the matter is called, written instructions, dated 20-07-2015 furnished by the Inspector of Police, Medipalli Police Station, Cyberabad Commissionerate have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is respectfully submitted that as per the records, it is revealed that no complaint or case whatsoever was registered on the file of Medipally Police Station, Cyberabad against the petitioner herein.

It is submitted that the allegation of the petitioner that the 4th respondent influencing the local police who have called the petitioner to the police station Medipally and that the petitioner appeared before the SHO., Medipally and explained the entire facts and after knowing the entire facts and having satisfied with the innocence of the petitioner, he was released and that surprisingly on 7.7.2015 at about 4.00 p.m one lady made a call from Cell. No.9908018560 stating that she is SI of Medipally Police Station and threatened to come to the police

station immediately and settle the matter with the 4lh respondent otherwise he would be implicated in criminal cases is utterly false, baseless and hence denied. It is pertinent to submit that at no point of time, the unofficial respondents approached this respondent police station and lodged any oral or written complaint against the petitioner herein. This respondent police never summoned the petitioner to the police station nor asked him to settle the matter with the 4lh respondent herein and to hand over the subject property in question.

All the allegations made in the affidavit are false, baseless, concocted and particularly invented for the purpose of filing the present writ petition.

It is submitted that as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint in future, he rushed to this Hon'ble Court and filed the present writ petition." On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and close the writ petition.

In view of the above, the writ petition stands disposed of, by recording the written instructions, 20-07-2015 furnished by the Inspector of Police, Medipalli Police Station, Cyberabad Commissionerate.
