THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Tr.Crl.P.No.237 of 2013

ORDER

The petitioner seeks transfer of M.C.No.11 of 2012 on the file of Judicial First Class Magistrate, Jangaon to the Family Court, Ranga Reddy District, on the ground that she is staying with her parents at Hyderabad and it is very difficult to her to attend the Court at Jangaon for every adjournment.

2. Learned counsel for the petitioner would submit that earlier, the petitioner filed G.O.P.No.696 of 2013 on the file of Principal District Judge's Court, Warnagal, and she filed Tr.C.M.P.No.160 of 2014 before this Court seeking transfer of said GOP from the Principal District Judge's Court, Warangal to the Family Court, Ranga Reddy District, and in spite of notice, her husband i.e., second respondent herein, did not make any appearance in that matter and eventually, the said Tr.C.M.P.No.160 of 2014 was allowed by an order dated 22.04.2014, considering the inconvenience caused to her in attending the Court in G.O.P.No.696 of 2013, and therefore, on the same footing, the present petition may also be allowed.

3. The record shows that the respondent herein has received notice and engaged his counsel, but there is no representation. In these circumstances and having regard to the inconvenience faced by the petitioner, who is a woman, this Transfer Criminal Petition is allowed and M.C.No.11 of 2012 pending on the file of Judicial First Class Magistrate, Jangaon, Warangal District, is transferred to the Family Court, Ranga Reddy District, for disposal according to law.

Miscellaneous Petitions, if any, pending in this criminal petition, shall stand closed.
