THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.39041 OF 2015 ORDER:

This writ petition was filed assailing the action of the Commissioner of Prohibition and Excise, State of Telangana, Hyderabad, in not permitting the petitioner to change the address of the Bar and Restaurant being run by him at Kollapur Village, Mahabubnagar District.

Learned Assistant Government Pleader for Excise informed this Court that the Commissioner of Prohibition and Excise, State of Telangana, had issued proceedings dated 05.12.2015 rejecting the request of the petitioner. A copy of the said proceedings is placed on record.

Learned counsel for the petitioner pointed out that the Commissioner had also stated in the penultimate paragraph of the proceedings dated 05.12.2015 that the petitioner may make another application in Form-1A as per Rules applicable, if he wants to apply. Therefore, it is for the petitioner to take necessary action as advised pursuant to the proceedings dated 05.12.2015 issued by the Commissioner of Prohibition and Excise, State of Telangana, Hyderabad.

The cause in this writ petition does not survive for consideration on merits and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 11th December, 2015 IBL
