THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8563 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/A1, seeking to grant anticipatory bail to her in Cr.No.35/RCA-CR-2/2019 on the file of Anti-Corruption Bureau, City Range-2, Hyderabad District, registered for the offences under Section 13(1)(b) read with Section 13(2) of the Prevention of Corruption Act, 1988 (as amended in 2018). 2.

Heard learned counsel for the petitioner/A1, learned Special Public Prosecutor for ACB representing the respondent and perused the record.

During hearing, learned Special Public Prosecutor for ACB submits that the petitioner/A1 was arrested on 02.01.2020 and sent to judicial custody in connection with the aforesaid crime and she has applied for regular bail before the Principal Special Judge for SPE & ACB Cases, Hyderabad, in Crl.M.P.No.60 of 2020, and therefore, the present criminal petition for anticipatory bail is not maintainable.

In view of the submission made by the learned Special Public Prosecutor for ACB that the petitioner/A1 was in judicial custody in connection with the aforesaid crime, this criminal petition is dismissed as not maintainable.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
