HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25468 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondent Nos.3 and 4 in calling the petitioner to the police station, day-in and day-out, at the instance of the 5th respondent.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that petitioner is running hotel in the name and style of 'L.A.Vantage Green Café', opposite ESI Hospital, Tirupathi; that the respondents 3 and 4 received information from the reliable sources that the petitioner is conducting illegal activities in the hotel; and that thereon the Sub-Inspector of Police, Tiruchanoor Police Station, Tirupathi Urban District, tried to serve notice to the petitioner under A.P.Public Safety Enforcement Act 2013, but the petitioner evaded to receive the said notice. It is also stated that the respondents followed the due procedure to serve the notice to the petitioner, but the petitioner instead of receiving the said notice and giving explanation to the same, filed the present writ petition. It is further stated that the 5th respondent did not lodge any complaint against the petitioner. The allegation that at the instance of 5th respondent, the respondents 4 and 5

called the petitioner and detained him in the police station on 19.08.2018, was also denied.

Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of. However, the respondents 3 and 4 shall not interfere with the life and liberty of the petitioner, except in accordance with law. No order as to costs.
