THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.21283 of 2007 ORDER:

Heard Smt Geetha holding for Mr.V.Mallik, counsel for petitioner.

On 24.09.2007, one D.Ranga Reddy aged 70 years, in his capacity as President of Giddalur Retired Employees Association filed the present writ petition for the following relief:

".........writ of mandamus to take further action in pursuant to the proceedings dated 04.04.2005 issued by the 2nd respondent herein and to hand-over the building to the petitioner-association represented by the President for continuing the construction which was sanctioned in proceedings dated 07.03.2002 in Rc.C/365/2001 issued by the 2nd respondent herein by declaring the inaction as illegal, arbitrary and violative of rights guaranteed under Article 14 and 21 of the Constitution of India......"

Neither the petitioner nor the respondent is in a position to place before the Court, the present state of affairs vis-a vis of subject premises.

Be that as it may, the Tahsildar/respondent No.3 filed additional counter affidavit stating that the subject premises was constructed for utilization of pensioners within the premises of M.R.O., Office, Giddalur and every day in the morning, the building will be opened to enable the

pensioners to utilize the building and in the evening building will be closed and locked and the key will be under the control of Tahsildar, Giddalur.

Except for the above facility, the Tahsildar contends that petitioner cannot expect more.

By placing on record, the additional counter affidavit of Tahsildar dated 09.09.2009, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
