THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No. 174 of 2015 P.C: (per the Hon'ble Sri Justice A.Ramalingeswara Rao) This writ appeal is preferred against the order, dated 03.07.2013, passed in W.P.No.18884 of 2013, which was disposed of by the learned Single Judge of this Court in the following terms:
"It is agreed by both sides that the cause in this writ petition is identically the same, which is as stated in W.P.Nos.4978 of 2010 and 1040 of 2012, which stood disposed of by this Court on 06-11-2012 in the following terms.
"I therefore direct the State Government to immediately take up or reconsider the claims and cases of the petitioners herein and also all other similarly placed Work Inspectors either Technical or Non-Technical, who suffered a similar or identical break in service and pass appropriate orders of regularization of their services duly condoning the break period as was done by them earlier through G.O.Rt.No.9, dated 18-01-2010 and G.O.Rt.No.114 dated 04-05-2010. But, however, the monetary relief is confined with prospective effect in those cases. Therefore, even in the present case, it is open to the State Government to confine the monetary relief with effect from the date on which the orders are to be passed by them. Let this exercise be completed and appropriate orders be communicated within a maximum period of three months from today."
Hence, this writ petition also stands disposed of after hearing the learned Government Pleader for Housing for the 1st respondent and the l earned Standing Counsel for the A.P. State Housing Corporation Limited, who accepted notice on behalf of respondents 2 and 3, subject to the same terms as referred to above."
It is represented by the learned counsel for the appellants that after passing of the order in the writ petition, the case of the persons similar to respondent No.1 was considered and the Government issued orders in G.O.Ms.No.260 Housing (U&LAY) Department, dated 25.11.2013. He also submits that respondent No.1 herein retired from service. However, he states that the present writ appeal is filed with the apprehension that respondent No.1 may file a contempt case alleging noncompliance of the order. This apprehension has no basis in view of the subsequent order of the Government in G.O.Ms.Nos.260, dated 25.11.2013, considering the cases of the persons similarly situated like that of respondent No.1.
In view of the compliance of the orders passed by this Court in W.P.No.4978 of 2010 and batch, dated 06.11.2012 and also in view of G.O.Ms.No.260, dated 25.11.2013, we are of opinion that nothing survives for adjudication in the present writ appeal.
Writ appeal is accordingly dismissed.
Consequently, miscellaneous petitions, if any, also stand disposed of.
