HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.2282 of 2013 ORDER :

This criminal petition is filed by the petitioners/accused Nos.1, 2 and 4 to 6 under Section 482 Cr.P.C to quash the proceedings in Crime No.15 of 2013 of Rompicherla Police Station, Guntur District, registered for the offences punishable under Sections 420 and 406 IPC and 5 of PC & MCSB against the petitioner/ accused Nos.1 to 6.

2) It is represented by the learned Public Prosecutor that the prosecution agency filed charge sheet after investigation in the above crime and the learned Magistrate committed to the Court of Sessions and the same is numbered as S.C. No.63-S/2014, the present proceedings sought for against the F.I.R no way survives and as such the petition becomes infructuous.

3) In the result, the petition is dismissed as infructuous, giving liberty to petitioners/ accused Nos.1, 2 and 4 to 6 to file fresh application for quash the police final report including part-II CD and other material and the cognizance, if any, taken by learned Magistrate or to file an application for discharge under Section 227 Cr.P.C before the learned Court of Sessions as the case may be.
