ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/accused seeking to quash the proceedings in D.V.C. No.9 of 2013 on the file of III Metropolitan Magistrate, Cyberabad at L.B.Nagar. The main contention raised by the learned counsel for petitioners is that the relief sought by the 02nd Respondent herein is only pertaining to petitioner No.1 - accused No.1 and as far as the allegation of threat of protection is concerned, at the time of filing of this Criminal Petition, petitioners as well as respondent No.2 are living 90 KMs away from each other and hence, the question of threat from the petitioners to the respondent No.2 does not arise. Further, it is informed by the learned counsel for the petitioner and also by the learned counsel for the 02nd Respondent that already divorce petition was filed.

Considering the aforesaid facts and circumstances of the case, the proceedings in D.V.C. No.9 of 2013 on the file of III Metropolitan Magistrate, Cyberabad at L.B.Nagar are quashed as far as petitioner Nos.2 to 5 are concerned. As far as the petitioner No.1 - accused No.1 is concerned, he is directed to face the trial before the concerned Court and the concerned Court is also directed to dispose of the D.V.C. as expeditiously as possible.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions filed in this criminal petition, if any, pending, shall stand closed.
