THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.32506 of 2016 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the inaction of the seventh respondent in disposing of the representation of the petitioner dated 04.09.2016 as illegal and arbitrary.

Heard the learned counsel for the petitioner, the learned Government Pleader for fisheries (Andhra Pradesh), representing the respondent Nos.1, 2, 4, 5 and 6, the learned Government Pleader for Home (Andhra Pradesh) representing the 7th respondent and the learned Government Pleader for Revenue (Andhra Pradesh), representing the 3rd respondent.

The petitioner - Fishermen Co-operative Society was registered under Co-Operative Societies Act way back in the year 1947, vide Regd.No.1-46/ 1947. A perusal of the record reveals that the sixth respondent granted fishing rights in favour of the petitioner society for a period of three years with effect from 01.07.2015 to 30.06.2018 in respect of Kusumupuram Swamp, Kaviti swamp, Hattibadi and Dakkathapotanna Tanks. The grievance of the petitioner is that the neighbouring villagers committing theft of fish in the tanks allotted to the petitioner society. A perusal of the record reveals that the petitioner society submitted a representation to the seventh respondent on 04.09.2016 with a request to take appropriate action against the

wrong doers. For one reason or other, the seventh respondent has not taken any action so far.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the seventh respondent to dispose of the representation of the petitioner dated 04.09.2016. The learned Assistant Government Pleader also consented for the same.

In view of the submissions made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the submissions made by both the counsel, the seventh respondent is hereby directed to dispose of the representation of the petitioner dated 04.09.2016 as expeditiously as possible, preferably, within a period of three weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel, the miscellaneous petitions, pending if any in this writ petition, shall stand closed. ______________________ T.SUNIL CHOWDARY, J September 23, 2016.
