CVNR, J CRP.No.4203 of 2018 Dt:26.7.2018 ORDER:

The concurrent findings of fact regarding possession of the respondent rendered by both the Courts below are questioned in this Civil Revision Petition.

After hearing the learned counsel for the petitioners, I am of the opinion that the orders of the Courts below do not suffer from any illegality, irregularity and impropriety warranting interference with the interim injunction order, dated 31.8.2017, granted by the Principal Junior Civil Judge, Chodavaram in I.A.No.196 of 2017 in O.S.No.63 of 2017 pending the suit and as confirmed by the IX Additional District Judge (Fast Track Court), Chodavaram in C.M.A.No.42 of 2017, vide judgment, dated 18.4.2018.

The Civil Revision Petition is, accordingly, dismissed, however, making it clear that the findings rendered by the Courts below shall not have any bearing on the adjudication of the suit.

As a sequel to dismissal of the Revision Petition, IA.No.1 of 2018 filed for interim relief shall stand dismissed. ___________________________ JUSTICE C.V.NAGARJUNA REDDY 26th July, 2018 DR
