HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12637 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not considering the case of the petitioner for promotion to the the post of TI-II on par with his junior with effect from 04.11.2000, as illegal and arbitrary. Learned counsel for the petitioner has contended that the petitioner is seeking notional promotion on par with his junior and appropriate orders may be passed directing the respondents to consider the case of the petitioner for notional promotion on par with his junior.

Learned standing counsel for the respondents has contended that the petitioner has filed this writ petition after retirement and hence the case of the petitioner cannot be considered for promotion at this point of time and there are no merits in the writ petition and the same is liable to be dismissed.

This Court having considered the rival submissions made by the parties is of the considered view that the writ petition can be disposed of directing the petitioner to submit a representation to the respondents seeking notional promotion on par with his junior within two weeks from the date of receipt of a copy of this order and upon receiving such representation, the respondents shall consider the same and pass appropriate orders, in accordance with law, in four weeks thereafter.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 17th December, 2018 cbs
