THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.76 OF 2016 ORDER:

This Criminal Revision Case is filed by the accused seeking to set aside the order of Judicial Magistrate of First Class, Tanuku, West Godavari District dated 18.12.2015 in dismissing Crl.M.P.Sr.No.11397 of 2015 in C.C.No.738 of 2010, whereby the learned Magistrate refused to recall the NonBailable Warrant issued against the petitioner on 18.02.2011. Heard the learned counsel for the petitioner and learned Additional Public Prosecutor. Perused the material on record. In the circumstances of the case, the petitioner is directed to surrender before the Court below and file an application seeking to recall the warrant. On filing such application, the Court below is directed to recall the Warrant issued against the petitioner on the same day on execution of a bond by the petitioner for a sum of Rs.1,000/- with one surety with an undertaking for his further appearance for trial before it. The Criminal Revision Case is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
