THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11612 of 2025 ORDER:

Seeking the Court to enlarge the petitioner, who arrayed as accused No.3 in Crime No.1 of 2025 of Cyberabad Narcotics Police Station, TG Anti-Narcotics Bureau, on bail, the present petition is filed.

The brief facts of the case are that, on 03.04.2025, on credible information that Nigerian nationals were involved in the illegal supply of drugs, the police conducted a raid, intercepted the accused, and seized 16.45 grams of cocaine and 52.29 grams of MDMA, along with laptops, pen drives, mobile phones, weighing machines, and related documents. The accused were subsequently arrested, and the police registered a case vide Crime No.1 of 2025 for offences punishable under Sections 8(c), 22(b), 22(c), 27A, and 29 of the NDPS Act.

Heard Smt. Dr. J. Vijayalaxmi, learned counsel appearing for the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the allegations made against him and there are no specific allegations suggesting that the petitioner is a drug peddler; rather, the only accusation pertains to the transfer of funds to the account of Accused No.1, including a sum of Rs.45,000/- and that several co-accused, including Accused Nos.11 and 12, have already been granted bail, and the petitioner seeks parity with them. She further submitted that the petitioner was arrested on 04.04.2025 and has remained in custody since then. Additionally, Accused Nos. 6, 7, 8, and 10 has been granted bail, while Accused No.13 has been granted anticipatory bail. Therefore, prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are distinct from those against the other accused and the petitioner was found in the company of Accused Nos.1 and 2, who are identified as Nigerian nationals allegedly involved in drug peddling. The petitioner was present at the premises on the date when the police seized contraband from Accused Nos.1 to 3, and the quantity of contraband involved is substantial. He

further submitted that Accused Nos.1 and 2 are foreign nationals implicated in multiple cases and the investigation is still in progress, releasing the petitioner on bail at this stage may lead to tampering with evidence or intimidation of witnesses and prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is evident that, based on credible information, the police knocked on the door of the premises, a male Nigerian national opened the door and, upon seeing the police, attempted to close it. However, before he could do so, the police rushed into the premises and found another Nigerian national along with the petitioner in the room. The petitioner was present in the room along with Accused Nos. 1 and 2. According to the petitioner's confessional statement, he is the proprietor of Fine Multiple Service, Malakpet and in the year 2017, Accused No.1 visited his office and received money from the USA. He further requested the petitioner to facilitate payment despite lacking valid ID proof. In response, the petitioner provided the ID of his friend, Suhail Sayyed Abdul Azeez, and also shared details of certain USA-based bank accounts held by Indian nationals.

Having regard to rival submissions made, considering the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Special Judicial Magistrate of First Class cum V Additional Junior Civil Judge cum V Additional Judicial Magistrate, at LB.Nagar, Rangareddy, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, this Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
