K. Balaiah v. The Depot Manager, Apsrtc,Korutal Depot, Karimnagar Dist
HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19994 OF 2006 ORDER:
When this matter is taken up for hearing, the learned Counsel for the petitioner submitted that the petitioner has expired during the pendency of this writ petition and his legal representatives were brought on record. He further submitted that it is a case where the Industrial Tribunal dismissed the I.D. preferred by the petitioner against his removal. Since the petitioner expired, the question of his reinstatement would not arise. However, ends of justice would be met if the writ petition is disposed of directing the respondents to pay the service benefits for the services rendered by the deceased petitioner prior to his removal. Accordingly, the Writ Petition is disposed of directing the respondent to pay the service benefits for the services rendered by the deceased petitioner prior to his removal, to the legal representatives of the petitioner, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions, pending if any, shall stand closed.
